Welcome to Thea Dawn LLC: (“Thea Dawn,” “we,” “us,” or “our”), a limited liability company registered in the State of Indiana. These Terms of Service (“Terms”) govern your use of our website, mobile applications (“Apps”), books (digital and paperback), in-app purchases, recurring subscriptions, Find Care Network referrals, and other digital products or services (collectively, the “Services”) offered by Thea Dawn. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

1. Acceptance of Terms

By purchasing, downloading, or using our Apps, books, subscriptions, or other Services, whether through our website, the Apple App Store, Google Play Store, Kindle Direct Publishing, or other platforms, you agree to these Terms and our Privacy Policy. These Terms apply to all users, including visitors, registered users, and customers.

2. Eligibility

You must be at least 18 years old or have the consent of a parent or legal guardian to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Purchases

Thea Dawn offers digital and physical products, including Apps, in-app purchases, recurring subscriptions, and books (digital via Kindle Direct Publishing and paperback). All purchases are subject to the following terms:

3.1 App Purchases

• Availability: Our Apps are available for purchase or download on the Apple App Store and Google Play Store.

• Payment: Payments for Apps are processed by the respective platform (Apple or Google). You agree to comply with their payment terms and conditions.

• Non-Transferable: App purchases are non-transferable and tied to your App Store or Google Play account.

• Refunds: Refunds for App purchases are subject to the refund policies of the Apple App Store or Google Play Store. Thea Dawn does not directly process refunds for Apps.

3.2 In-App Purchases and Subscriptions

• In-App Purchases: Certain features or content within our Apps may require one-time in-app purchases. These purchases are non-refundable unless otherwise required by law or specified by the platform.

• Recurring Subscriptions: Some Services may include recurring subscriptions for premium content or features, including access to the Find Care Network. By subscribing, you authorize the platform (Apple App Store or Google Play Store) to charge your account on a recurring basis (e.g., monthly or annually) until you cancel.

• Cancellation: You may cancel subscriptions at any time through your App Store or Google Play account settings. Cancellation will take effect at the end of the current billing cycle, and no partial refunds will be provided.

• Free Trials: If offered, free trials for subscriptions will automatically convert to a paid subscription unless canceled before the trial period ends. You are responsible for monitoring and canceling trials if you do not wish to continue.

• Proceeds Allocation: A portion of proceeds (10%) from in-app subscriptions is allocated to support Thea Dawn’s mission, which may include producing books, printed materials, advertising, or distributing resources to communities globally. Thea Dawn reserves the right to determine how these funds are used to further our mission.

3.3 Book Purchases

• Digital Books: Digital books are sold through Kindle Direct Publishing. Purchases are subject to Amazon’s terms and conditions, including their refund and return policies.

• Paperback Books: Paperback books are sold through third-party platforms, such as Amazon. Returns and refunds for paperback books are governed by the retailer’s policies.

• Non-Transferable: Digital book purchases are tied to your Kindle or Amazon account and are non-transferable.

3.4 Pricing and Taxes

• All prices are listed in the currency specified on the platform where the purchase is made.

• You are responsible for any applicable taxes, duties, or fees associated with your purchase, as required by law or the platform’s terms.

4. Find Care Network

Thea Dawn offers a Find Care Network feature within our Apps, accessible via in-app subscriptions, which provides a list of hand-selected holistic health practitioners. The following terms apply:

• No Responsibility for Care: Thea Dawn is not responsible for the care, services, or outcomes provided by practitioners listed in the Find Care Network. We do not employ, partner with, or endorse these practitioners. The inclusion of a practitioner in the network is based on our research and belief that they may offer holistic health services, but it is not a guarantee of quality, suitability, or effectiveness.

• Referrals Only: The Find Care Network provides referrals to independent practitioners. These practitioners are not affiliated with Thea Dawn, do not sponsor their inclusion, and operate outside of our control. You are solely responsible for researching, selecting, and engaging with any practitioner.

• User Responsibility: Before engaging with any practitioner, you must thoroughly evaluate their qualifications, services, and compatibility with your health needs. Thea Dawn does not verify the credentials, licenses, or practices of listed practitioners. Any decisions or actions taken based on interactions with these practitioners are at your own risk.

• No Liability: Thea Dawn is not liable for any damages, losses, or adverse outcomes resulting from your interactions with practitioners in the Find Care Network, including but not limited to health-related issues, financial losses, or disputes.

5. License and Use of Services

• Apps and Digital Content: Upon purchase or download, Thea Dawn grants you a limited, non-exclusive, non-transferable, revocable license to use our Apps and digital content for personal, non-commercial use. You may not copy, modify, distribute, sell, or sublicense our Apps or content.

• Books: Digital and paperback books are licensed for personal use only. You may not reproduce, distribute, or create derivative works from our books without prior written consent from Thea Dawn.

• Find Care Network: Access to the Find Care Network is provided as part of certain in-app subscriptions and is for informational purposes only. You may not use the network for commercial purposes or share its contents publicly.

6. User Conduct

You agree not to:

• Use our Services for any unlawful or unauthorized purpose.

• Attempt to reverse-engineer, decompile, or hack our Apps or digital content.

• Share, distribute, or reproduce our Services or content, including Find Care Network information, without permission.

• Use our Services in a way that could harm, overload, or impair our systems or networks.

7. Intellectual Property

All content provided through our Services, including text, images, designs, logos, software, and the Find Care Network directory, is owned by Thea Dawn or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use our content for commercial purposes or without our express permission.

8. Disclaimer of Warranties

Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Thea Dawn does not guarantee that our Services will be error-free, uninterrupted, or free of viruses or other harmful components.

Our content, including health and wellness advice and Find Care Network referrals, is provided for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before using our Services, engaging with practitioners, or applying any health-related information.

9. Limitation of Liability

To the fullest extent permitted by law, Thea Dawn, its affiliates, and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising from your use of our Services, including interactions with practitioners in the Find Care Network. Our total liability for any claim related to the Services shall not exceed the amount you paid for the specific Service giving rise to the claim.

10. Termination

We reserve the right to suspend or terminate your access to our Services at our discretion, without notice, for any reason, including violation of these Terms. Upon termination, your license to use our Services will cease, and you must stop using our Apps, digital content, and products.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved in the state or federal courts located in Indiana.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or legal requirements. The updated Terms will be posted on our website with the “Last Updated” date. Your continued use of our Services after the changes constitutes your acceptance of the updated Terms.
